The terms and conditions of this agreement are set out below. Make sure you have read and understood the conditions before entering into the agreement. If you use this Website it is deemed that you have read and understood the terms and conditions and you agree to be bound by this agreement. Interpretation In this website:
“Gifthome” means Gifthome Australia.
“Website” means the whole or any parts of the web pages located at www.gifthome.com.au.
Disclaimer of Liability GiftHome does not warrant that this Website is compatible with your equipment or that this Website is free of errors or viruses or worms and is not liable for any damage you may suffer as a result of such destructive features. Gifthome will not accept responsibility or liability for any fault, inaccuracy, omission, delay or any other failure of this Website caused to your computer equipment.
We shall not be liable to any person (whether in contract, tort or otherwise) for any loss or damage suffered, or that may be suffered, as a result of any act or omission, whether negligent or otherwise, by or on behalf of us in relation to the provision of this service, or any other matter or thing relating to this agreement.
To the extent permissible by law, we expressly disclaim all conditions and warranties, express or implied, in respect of the service and products pursuant to this agreement. You shall release and indemnify us against any loss or damage whatsoever which we may suffer as a result of any action, proceeding, claim, demand or prosecution arising from the provision of the service and/or product, or any other matter or thing arising as a result of this agreement, including loss or damage arising from the negligent act or omissions of us, pursuant to this agreement. While we ensure that your orders are delivered to your specified address, we will not be liable for items damaged or lost in transit by third-party handling, or non-delivery due to an incorrect delivery address provided or for any other reasons. In any event we will not be liable to you in excess of any amount payable by you for any goods purchased on this Website. Force Majeure We shall not be in default under the terms of this agreement nor liable for failure to observe or perform in accordance with any provision of this agreement for any reason or cause which could not with reasonable diligence be controlled or prevented by it, including without limitation, war, insurrection, riot, civil commotion, strikes, lock-outs, labour or industrial disputes, acts of God, acts of Governments for flood, storm, tempest, power shortages or power failure, liability to obtain sufficient labour, raw materials, fuel or utilities. During the period of an incident or incidents of “Force Majeure” this agreement shall be suspended and delivery of any service and/or product will recommence at the option of us.
Variation These terms and conditions may be added, amended or varied by us at any time without notice to you. Merger All the rights, immunities and limitations of liability in this agreement shall continue to have their full force and effect in all circumstances notwithstanding any breach of contract or of any conditions hereof by us. Photography All items offered for sale are presented in photographs for descriptive purposes only. However, due to screen defaults and photography technique, there may be differences between the photograph and the actual items in terms of colors and sizes. Governing Law These Terms & Conditions are governed and construed in accordance with the laws of New South Wales, Australia. This Website may be accessed throughout Australia and overseas. Gifthome makes no representations that the content of this Website complies with the laws (including intellectual property law) of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access the site.
Trading Policy Gifthome Australia is an Australian-based company. All prices are inclusive of GST and are quoted in Australian dollars.
If your desired gift item is unavailable, we may offer you or may give you part or full refund for the unfulfilled order subject to our fees and other related fees. We are not liable to you for any damages caused by the unavailability of any items. Warranty, service and support of products are provided directly to you by manufacturer and supplier of the product. Subject to any rights which may not be excluded or limited, Gifthome makes no representations or warranties regarding any products. Payments PayPal PayPal is an account-based system that lets anyone with an email address securely send and receive online payments using their credit card or bank account. If you'd like to find out more about the system, please visit www.PayPal.com.au.
By selecting this method, you are electing to use PayPal to process your credit card payment direct to us at your own risk. You are able to use this method whether you have previously registered with PayPal prior to using this Website or are new customer to PayPal. Please note there is no charge to use PayPal if you are purchasing our products.
If you wish to use this option, select PayPal as your method of payment. Once you have confirmed your order with us, you will be presented with the PayPal login screen. If you have previously registered with PayPal, enter your email address and password and you will be logged in for immediate payment. If you do not have a PayPal account, click on the option stating that you do not have an account. You will then need to confirm your address and enter your credit card details. PayPal will automatically notify us that you have made payment and we will dispatch your order immediately.
Bank Deposit/ Transfer Payment (Australia only) By choosing this method you are electing to make a payment direct into our Australia bank account. At the end of the checkout process you will be presented with our bank account details. They will also be sent to you direct by email with your final invoice as a reminder of payment. You are then required to make a payment direct into our bank account, stating your invoice number (if possible) to enable us to match your payment with your order. As soon as we receive the payment into our account then we will dispatch your order. We shall not be liable to you or any person (whether in contract, tort or otherwise) for any loss or damage suffered, or that may be suffered, as a result of any unauthorized use of credit card, unauthorized deposit, transfer or payment or whatsoever without knowledge, authority or consent, in relation to the provision of this service, or any other matter or thing relating to this service.
You shall release and indemnity us against any loss or damage whatsoever which we may suffer as a result of any action, proceeding, claim, demand or prosecution arising from the provision of this service being misused or unauthorized use by any person , or any other matter arising as a result of this service. Delivery All orders are delivered by Australia Post via Parcel Post or Express Parcel Post. All orders are shipped from our warehouse located in Sydney, NSW. You will be notified by email once your order has been dispatched.
All deliveries are calculated by weight and destination postcode, delivery prices start as low as $5.20 for standard shipping.
Orders are usually dispatched within 1 - 2 business days but it may take longer. Deliveries are sent via regular parcel post and may take up to 7 working days or more to arrive if being sent to an Australian address. Occasionally we may run out of stock or we may experience unavailability of stocks for any reasons. If this occurs, you will be notified by email.
If you are not home to receive your delivery, a card will be placed in your mail box advising you to collect your parcel from your local post office. We shall not be liable to you or any person (whether in contract, tort or otherwise) for any loss or damage suffered, or that may be suffered, as a result of any act or omission to collect the card or parcel by you or by any one. You shall release and indemnify us against any loss or damage whatsoever which we may suffer as a result of any action, proceeding, claim, demand or prosecution arising from such act or omission.
Please note that whilst we make every effort to dispatch your item as soon as possible we cannot be held responsible for delays caused by the postal service. Late shipping does not constitute cancellation of an order. It is the responsibility of the customer to inform us if the goods have not arrived. We will not be held liable for any loss or damage resulting from late delivery.
Returns and Refunds Customer satisfaction is our top priority. Gifthome is happy to offer an unconditional refund policy. Simply return the item unused and in its original packaging by 30 days from date of purchase.
Gifthome will refund the cost of the item or allow you to exchange your product for another item depending on availability. Please note that postage and handling charges will not be refunded and shipping costs will be incurred by the customer for exchanged items.
If your purchased item is faulty on arrival, you must return your faulty goods to Gifthome within 14 days from the date of purchase in order to be eligible for replacement. You will receive a replacement item or a credit for the purchase if the item can not be replaced.
Procedure for the Return of Products
All products returned must contain all original packaging and documentation. Gifthome reserves the right to deny replacement of goods that have been poorly packaged and that have missing parts or have physical signs of abuse.
Returns take approximately 7 days to process from the date of receipt of returned products (exceptions to this may occur from time to time). Please note that: - All returns must have a Return Authorization (RA) number. - A replacement product will only be shipped after the defective item has been received by Gifthome. - Items that are returned to Gifthome without the RA number will be returned to sender.
